【公開申訴信】台灣賀寶芙長期職場霸凌與高層包庇真相

致 賀寶芙全球經營團隊及全體直銷商:

我是林安安,前台灣賀寶芙行銷部副理暨營養師,也是這起長期職場霸凌事件的受害者之一。這封公開信的目的,是為了正式表達我對台灣賀寶芙長期忽視職場霸凌問題,以及持續拒絕真誠處理受害者傷害的深切失望與擔憂。


1.經過勞動局確認的霸凌指控,高層卻選擇冷處理

2023年10月16日,我與兩位前同事正式向美國賀寶芙總部提出了職場霸凌申訴。經過漫長的調查程序,我們的指控不僅在內部獲得確認,更獲得了外部官方機構的背書:

  • 2024年1月29日: 賀寶芙內部調查確認霸凌屬實。
  • 2025年1月13日: 台北市政府勞動局於外部正式確認此霸凌事件。

然而,儘管有明確的調查結果,台灣賀寶芙卻未能採取任何具實質意義的糾正措施,反而試圖淡化並掩蓋問題的嚴重性。


2.表面工夫的「調職」與耗費鉅資的法律對峙

公司對被指控的霸凌者 Ally 採取的唯一措施,是將其調任為「優惠顧客資深經理」(Preferred Customer Manager)。但事實上,她的職級與薪資完全沒有改變,內部未發布任何調職公告,且仍在執行幾乎相同的工作。這樣的處置純粹是表面工夫,毫無實質究責。

過去兩年來,由台灣勞工局安排的多次調解皆告失敗。當時我們唯一的訴求僅是「道歉」以及「象徵性的一元賠償」,但台灣賀寶芙屢次拒絕進行有誠意的調解。相反地,公司選擇:

  1. 委任台灣最大的法律事務所(理律法律事務所 Lee and Li, Attorneys-at-Law)。
  2. 耗費數百萬元台幣聘請三名律師與受害者對峙。
  3. 試圖在調解會議中誤導勞工局,始終不願承認總部所確認的調查結果。

3.拒絕保護受害者,演變為職業傷害與不當解雇

2024年3月19日,我透過電話明確向人資 Alice 提出要求,希望能提供與霸凌者 Ally 物理隔離的工作環境,但公司斷然拒絕提供適當的保護措施

在此期間,長期的職場霸凌與心理折磨導致我身心受創:

  • 我被醫師診斷出患有伴隨混合焦慮與憂鬱情緒的適應障礙症
  • 此症狀已獲台灣勞動部認定為職業傷害

令人遺憾的是,台灣賀寶芙非但沒有保護受害者,反而於 2024年3月21日直接終止了我的僱傭關係。我堅信,包含 Stella (前總經理)、Ceasar (現任總經理) 與 Alice (人資) 在內的高層管理人員,刻意包庇霸凌行為,徹底辜負了維持企業安全且受尊重職場環境的基本責任。


4.有毒的系統性問題與司法判決的真相

這個問題遠遠超出了最初申訴的個人範疇。多年來,台灣賀寶芙內有多位現任與前任員工皆經歷過類似的霸凌事件。這反映出公司內部存在著更廣泛的系統性問題與有毒文化

此事曾遭台灣媒體報導,嚴重損害了公司的公眾聲譽,並引起直銷商與大眾對內部管理的擔憂,進而影響了銷售業績。但公司面對公眾關注,僅對媒體做出制式回應,從未直接聯繫受害者或表達歉意

更甚者,公司疑似指示霸凌者 Ally 對我提出刑事告訴,指控我不當洩露個資。然而,經過司法調查:

  • 刑事案件: 台灣檢察官已對我作出不起訴處分,證實該指控缺乏法律依據。
  • 民事案件(加班費爭議): 針對台灣賀寶芙未依《勞動基準法》給付加班費一事,我已在法庭上贏得勝訴(臺灣士林地方法院 113 年度勞小字第 39 號民事判決)。

這些客觀的司法紀錄,進一步證明了公司持續漠視員工權益,並習慣利用法律壓力來對付員工,而非著手解決正當的職場問題。


致所有賀寶芙直銷商的沉痛呼籲

致所有正在閱讀這封信的賀寶芙直銷商:也許你們從賀寶芙身上得到了金錢、成就,以及一份專注於健康的事業。

然而,一間充滿劣質與毒性的公司不該被這些外在的不實表現所掩蓋。請明白,你們購買的每一個賀寶芙商品,都在選擇讓這件職場霸凌事件和有毒公司文化繼續惡化。


對賀寶芙全球總部的三大嚴正訴求

作為一家全球知名的跨國企業,賀寶芙理應秉持企業社會責任。我鄭重地要求賀寶芙總部:

  1. 啟動透明調查: 立即針對本申訴書中所述事項,啟動全面、公正且透明的調查。
  2. 支持與補償: 為所有曾遭到職場霸凌的前員工們提供適當的支持與補償。
  3. 高層連帶懲處: 不僅要對霸凌者 Ally 實施適當的紀律處分,也必須對明知卻包庇霸凌行為的高層主管(包括 Stella、Ceasar 與 Alice)進行嚴厲懲處。

我們目前正對台灣賀寶芙採取法律行動。除非賀寶芙嚴肅對待並妥善解決這些問題,否則我們絕不會停止。我希望總部能展現出當責與誠信,並歡迎隨時與我聯繫,我將會向您展示所有確鑿的證據。

【Open Letter of Complaint: Prolonged Workplace Bullying and Mismanagement at Herbalife Taiwan】
Dear Herbalife Global Team and all Herbalife Distributors,

My name is Anan Lin, former Herbalife Assistant Marketing Manager & Dietitian, and I am one of the victims involved in the workplace bullying case at Herbalife Taiwan. I am writing to formally express my deep disappointment and concern regarding Herbalife Taiwan’s long-term negligence in handling workplace bullying and its continued refusal to sincerely address the harm caused to victims.

On October 16, 2023, together with two former colleagues, I submitted a formal workplace bullying complaint to Herbalife Headquarters in the United States. Following the investigation process, the allegations were confirmed internally on January 29, 2024, and externally by the Department of Labor, Taipei City Government (台北市政府勞動局) on January 13, 2025. However, despite this result, Herbalife Taiwan has failed to take meaningful corrective action and instead attempted to minimize and conceal the seriousness of the issue.

The only measure taken by the company was reassigning the accused bully, Ally, to the position of Preferred Customer Senior Manager. Nevertheless, her rank and salary remained unchanged, no internal announcement regarding this reassignment was made, and in practice, she continues performing nearly identical duties. This action is purely superficial and does not reflect genuine accountability.

Over the past two years, multiple mediation sessions arranged by Taiwan’s Labor Bureau have failed because Herbalife Taiwan repeatedly refused to engage in sincere mediation with the victims (at that time, our only requests were an apology and a symbolic compensation of one NT dollar). Instead, the company appointed Taiwan’s largest law firm (Lee and Li, Attorneys-at-Law), spending millions of NT dollars to hire three lawyers to confront us during mediation meetings and attempted to mislead the Labor Bureau regarding the circumstances of the case.

Herbalife Taiwan has consistently refused to acknowledge the investigation findings confirmed by headquarters, choosing instead to deny the seriousness of the bullying allegations and spend substantial resources defending the company’s position while refusing to apologize to the victims.

Furthermore, despite my explicit request during a phone call with Alice (HR) on March 19, 2024, for a physically separated working environment from Ally, the company refused to provide appropriate protection measures. During this period, due to prolonged workplace bullying and psychological distress, I was diagnosed with an adjustment disorder with mixed anxiety and depressed mood, which was subsequently recognized as an occupational injury by Taiwan’s Ministry of Labor.

Nevertheless, instead of protecting me as a victim, Herbalife Taiwan directly terminated my employment on March 21, 2024. I strongly believe that senior management, including Stella (Former GM), Ceasar (GM), and Alice (HR), deliberately protected the bully and completely failed in their responsibility to maintain a safe and respectful workplace at Herbalife.
I must also emphasize that this issue extends far beyond the individuals originally identified in the October 16, 2023 complaint. To my knowledge, over the years, several current and former employees have experienced similar workplace bullying incidents within Herbalife Taiwan. This reflects a broader systemic problem and toxic culture within the company’s workplace that requires serious review and reform.

Taiwanese media outlets have also reported on workplace bullying incidents involving Herbalife Taiwan, which has significantly damaged the company’s public reputation, raised concerns among distributors and the public regarding internal management practices, and subsequently severely impacted Herbalife Taiwan’s sales performance. Despite the public attention, the company has only responded to media inquiries and has never directly contacted or apologized to the victims. This has left me feeling deeply disappointed and helpless.

Even worse, Herbalife Taiwan is suspected of instructing Ally to file a criminal accusation against me, alleging that I had improperly disclosed personal information to the public. However, after investigation, Taiwanese prosecutors decided not to indict me, confirming that the accusation lacked sufficient legal basis.

In addition, Herbalife Taiwan previously failed to pay overtime wages in accordance with Taiwan’s Labor Standards Act. I have already won this case in court, and the judgment is part of the public record (Taiwan Shilin District Court Civil Judgment, Year 113, Lao Xiao Zi No. 39). These incidents further demonstrate the company’s ongoing disregard for employee rights and its pattern of using legal pressure against employees instead of addressing legitimate workplace concerns.

To all Herbalife distributors reading this: Perhaps you have gained financial rewards, personal achievements, and a health-focused business through Herbalife. However, a toxic and inferior company should not be allowed to hide behind these false outward appearances. You must realize that every Herbalife product you purchase is a choice that allows this workplace bullying incident and toxic corporate culture to deteriorate further.

Therefore, I respectfully request that Herbalife Headquarters:
1.Immediately launch a comprehensive, impartial, and transparent investigation into the matters described in this complaint.
2.Provide appropriate support and compensation for all former employees who have suffered from workplace bullying.
3.Impose appropriate disciplinary actions not only against the bully, Ally, but also against senior executives who knowingly protected the workplace bullying behavior, including Stella, Ceasar, and Alice.

As a globally recognized company, Herbalife is expected to uphold corporate social responsibility and maintain a safe and respectful workplace environment for all employees. I sincerely hope this issue will receive the attention it deserves and be handled fairly and responsibly.

We are currently pursuing legal action against Herbalife Taiwan, and we will not stop unless Herbalife takes and settles these matters seriously. I hope the headquarters will demonstrate accountability and integrity, and I welcome you to contact me at any time. I will show you all the evidence.
